Supreme Court overrules ban on entry of Michael Chorni in Bulgaria

The Foreigners Act contradicts the European Convention on Human Rights

The Supreme Administrative Court (SAC) overruled on Tuesday the ban for businessman Michael Chorni to enter Bulgaria. The magistrates reaffirmed the decision of the lower instance court which had declared the order barring entry in the country null and void.

The amendment in the Foreigner's Act which revokes judicial control on orders of the National Security Service connected to national security considerations blatantly contradicts the European Convention.

According to the court, the motives with which the National Security Service and the prosecutor's office appealed the decision are unfounded. The court's motives also state that the amendment in the Foreigner's Act - which revokes judicial control on orders of the National Security Service connected to national security considerations - is in blatant contradiciton with the European Convention on Human Rights.

The order which revoked Chorni's residence permit in Bulgaria however remains in force. A week ago the Sofia City Court confirmed the order. The Supreme Court will hear this case also.

In August 2000, Michael Chorni's residence permit was taken away with the motive that he poses a threat to national security.
