  Concerning the recommendation of the European Commission against Racism and Intolerance that domestic penal legislation should include a provision stating that racist motivation constitutes an aggravating circumstance, the Government states that this has been the established practice of the courts in Bulgaria. The Government has not cited court rulings in support of its statement. We do not know of any case where a Bulgarian court has imposed a heavier sentence, on the grounds that the racist motivation of the perpetrator constituted an aggravating circumstance.
